1. About these terms
Made by Ken B is the name Ken uses for his independent product studio. In these terms, “Made by Ken B,” “we,” “us,” and “our” refer to Ken and the studio. These Terms of Service govern your access to and use of madebykenb.com. By using the site, you agree to these terms. If you do not agree, please do not use the site.
2. Information, not a client agreement
This site provides general information about the studio and its work. Visiting the site, following a link, or sending an inquiry does not create a client, partnership, employment, fiduciary, or confidential relationship.
Any paid project, deliverable, timeline, fee, ownership term, support commitment, or warranty must be set out in a separate written proposal, statement of work, or service agreement. If that agreement conflicts with these website terms, the project-specific agreement controls for that project.
3. Site content and intellectual property
Unless otherwise stated, the site's original text, design, graphics, branding, and code are owned by Ken or used with permission. Third-party names, logos, project materials, and trademarks remain the property of their respective owners.
You may view and use the site for your own lawful, noncommercial informational purposes. You may not copy, republish, sell, modify, distribute, frame, or create derivative works from site content without prior written permission, except where applicable law allows it.
4. Acceptable use
You agree not to:
- Use the site for an unlawful, fraudulent, or harmful purpose.
- Attempt to bypass security, gain unauthorized access, or interfere with the site or its hosting infrastructure.

5. Messages and project ideas
Do not send trade secrets, passwords, regulated data, or other highly sensitive or confidential material before a written confidentiality agreement is in place. You retain ownership of materials you send. You give us permission to use them only as reasonably necessary to review and respond to your inquiry, unless we agree otherwise in writing.
Sending an idea or inquiry does not require either side to proceed with a project and does not prevent the studio from working on other projects, including projects that may involve similar general concepts.
6. Third-party websites
Links to LinkedIn, GoFundMe, or other third-party websites are provided for convenience. Made by Ken B does not control those services and is not responsible for their content, availability, security, or privacy practices. A link does not necessarily mean endorsement.
7. Availability and disclaimers
The site is provided on an “as is” and “as available” basis for general informational purposes. To the fullest extent permitted by law, Made by Ken B disclaims warranties regarding the site's accuracy, completeness, availability, security, fitness for a particular purpose, and noninfringement. We may change, suspend, or remove site content at any time.
These website disclaimers do not replace any express commitments made in a signed project agreement.
8. Limitation of liability
To the fullest extent permitted by law, Made by Ken B will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of, or inability to use, this site. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, and any mandatory consumer rights remain unaffected.
9. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute relating to these terms or the site will be brought in a court with proper jurisdiction in Pennsylvania, unless applicable law requires otherwise.
10. Changes and severability
These terms may be updated as the site or studio changes. The effective date at the top identifies the current version. If any part of these terms is found unenforceable, the remaining parts will continue to apply.
